Terms of Service, Liability Waiver, Privacy Policy, Refund Policy, and Customer Agreement

Welcome to Phoenix Roadside Assistance LLC (“Company,” “we,” “our,” or “us”). By accessing our website, requesting services, scheduling an appointment, paying a deposit, making a payment, or receiving services from Phoenix Roadside Assistance LLC, you agree to be legally bound by this Agreement.
1. SERVICES PROVIDED
Phoenix Roadside Assistance LLC provides roadside assistance and automotive support services including but not limited to:
Services are subject to technician availability, weather conditions, traffic conditions, road conditions, and safety concerns.
2. $75 NON-REFUNDABLE BOOKING DEPOSIT
A $75.00 Non-Refundable Booking Deposit is required before any appointment can be scheduled or a technician dispatched.
The deposit covers scheduling, dispatch, travel, and administrative costs.
The deposit is non-refundable under all circumstances, including:

To the fullest extent permitted by law, the customer releases, waives, and forever discharges Phoenix Roadside Assistance LLC, its owner, officers, employees, contractors, agents, and representatives from any and all claims, damages, liabilities, losses, expenses, costs, and causes of action arising from or related to:

7. PRE-EXISTING VEHICLE CONDITIONS
Phoenix Roadside Assistance LLC is not responsible for:

The Company is not responsible for damages or failures resulting from:

The customer understands that lockout services may require specialized tools and procedures.
Phoenix Roadside Assistance LLC shall not be liable for unavoidable minor damage occurring during reasonable lockout procedures.
11. FUEL DELIVERY DISCLAIMER
Customers are solely responsible for providing the correct fuel type.
Phoenix Roadside Assistance LLC is not responsible for damages caused by incorrect fuel information provided by the customer.
Fuel costs are separate from service fees and must be paid by the customer.
12. THIRD-PARTY TOWING DISCLAIMER
Towing services may be provided through independent third-party towing companies.
Phoenix Roadside Assistance LLC is not liable for:
All towing-related claims must be directed to the towing provider.
13. LIMITATION OF LIABILITY

19. GOVERNING LAW
This Agreement shall be governed by the laws of the State of New York.
20. WEBSITE USE

By using this website, requesting service, paying a deposit, scheduling an appointment, or receiving services from Phoenix Roadside Assistance LLC, the customer acknowledges that they have read, understood, and agreed to all terms contained within this Agreement.
